The Great HomeAway ® Giveaway Sweepstakes Terms & Conditions

1. ELIGIBILITY:
The Great HomeAway ® Giveaway Sweepstakes (the "Sweepstakes") is open only to legal residents of the fifty (50) United States (including the District of Columbia), who are eighteen (18) years of age or older at the time of entry. Employees of HomeAway, Inc., as well as the spouses, children, parents, grandparents, and household members of each such employee, are not eligible. The Sweepstakes is subject to all applicable federal, state, provincial, and local laws and regulations and is void where prohibited by law.

2. SPONSOR:
The Sweepstakes is sponsored by HomeAway.com Inc., 3801 South Capital of Texas Highway, Suite 150, Austin, TX  78701 ("Sponsor").

3. AGREEMENT TO OFFICIAL RULES:
By participating in the Sweepstakes, entrant warrants that he/she fully and unconditionally agrees to and accepts these Official Rules and the decisions of Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. ENTRY PERIOD:
The Sweepstakes begins on September 9, 2008 at 12:00 a.m. Central Time ("CT") and ends on October 10, 2008 at 11:59 p.m. CT (the "Entry Period"). Entries received before or after the Entry Period are void.

5. HOW TO ENTER:
There are two methods to be qualified to enter The Great HomeAway ® Giveaway Sweepstakes: One: Travelers located their desired vacation property by performing a search on HomeAway.com. Travelers then complete the entry submission form including populating the selected property number in the requested field.  Travelers may submit one entry during the entry period, however, by referring a friend to the sweepstakes, a traveler's name will be entered a second time. All entries must be entered on HomeAway.com. Two: On a 3"x5" card, in black or blue ink hand print your full name, complete home address (including zip code), home telephone number with area code, date of birth, gender, email address (if available), and in the upper right hand corner of the card, your home phone number (including area code) followed by your first, middle and last initials, and mail in a first-class, postage-prepaid #11 envelope to: The Great HomeAway Giveaway Sweepstakes, c/o HomeAway.com, 3801 South Capital of Texas Highway, Suite 150, Austin, TX 78704. No mechanically reproduced mail-in entries will be accepted. Mail-in entries must be received by Sponsor within 7 days of the drawing. ALL OTHER MAIL-IN ENTRIES ARE VOID.

Any use of robotic, automatic, programmed or the like entry methods will void all entries by such methods. All entries are the property of Sponsor. It is the sole responsibility of the entrants to notify the Sponsor in writing by postal mail, at the address set forth above, if the entrant changes his or her email or postal address.

6. DRAWINGS:
On or about October 17, 2008 Sponsor will select the name of potential winners in a random drawing from all eligible entries received. Sponsor's decision as to the selection of the potential winners is final. 

7. REQUIREMENTS OF POTENTIAL WINNERS:
Potential winners will be notified within approximately ten (10) days of the drawing date. Except where prohibited, potential winners will be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within ten (10) days of being notified. If a potential winner is a minor then the entry will be disqualified under the rules, and another winner will be selected.

8. GRAND PRIZE:
One winner will receive a $10,000.00 vacation anywhere in the world at the selected HomeAway property of their choice. Stay dates are subject to availability and home owner approval. Stay must be consumed by October 31, 2009. Airfare purchase is the responsibility of the winner and may be organized centrally through HomeAway. The total cash value of the grand prize will not exceed $10,000.00 as determined by the sum of the published price for the property and the final prices for the airfare. Should the stay dates and nightly rental rate exceed the $10,000.00 cash value of the grand prize, the winner is responsible for paying any and all additional fees associated with the rental terms. Prizes are nontransferable (the "cash value" of the Grand Prize is $2,500.00, which will be paid if the winner does not wish to use the prize itself). The Sponsor who reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. Prizes will be mailed within thirty (30) days of Sponsor's receipt of a properly completed Affidavit/Release from an eligible entrant. Winners are responsible for any and all applicable fees and taxes associated with a prize. Prizes must be shipped to an address within the fifty (50) United States (including the District of Columbia).

9. OTHER PRIZES:
100 second-place winners will receive a gas card valued at $100.00 and 1000 third-place winners will receive a HomeAway ® frisbee .

10. CHANCES OF WINNING:
Chances of winning are as follows: one grand prize winner has 0.0001% chance of winning, second-place winners have 0.0059% chance of winning and third-place winners have a 0.0589% chance of winning.

11. PUBLICITY:
Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Sponsor's use of winner's name and country of residence for promotional purposes in any media without further payment or consideration. If the Grand Prize winner accepts the cash value, the Sponsor reserves the right to suspend or cancel any promotions featuring the prize winner.

12. PRIVACY:
All information submitted to Sponsor as part of this Sweepstakes will be treated in accordance with Sponsor's privacy policy, available at http://www.homeaway.com/index.cfm/tgt/privacy. Entrants have the right to access, withdraw, and correct their personal data. Entrants may request such action by filling out a form at http://support.homeaway.com/.

13. GENERAL CONDITIONS:
Sponsor reserves the right in its sole discretion to cancel, suspend, and/or modify the Sweepstakes if any fraud, computer virus, or other technical problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorized account holder.

14. RELEASE AND LIMITATIONS OF LIABILITY:
Except where prohibited, by participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor, HomeAway.com and HomeAway, Inc., and their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

15. DISPUTES:
Except where prohibited, entrant agrees that any and all disputes, claims and clauses of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Travis County, Texas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the law rules (whether of Travis County, Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Travis County, Texas.

16. SWEEPSTAKES RULES AND RESULTS:
For a list of winners, send a self-addressed stamped envelope to The Great HomeAway Giveaway Sweepstakes, HomeAway.com, 3801 South Capital of Texas Highway, Suite 150, Austin, TX 78704. Requests must be received by October 27, 2008.
